Could you tell me why you want ToS to not be required, as it is supposed to be required by default in any system...

Note: Joomla global consent does not have required option, as it a ToS is always required when needed before submitting a form...

For now, i won't change this requirement, but i've planned to add later a custom form field of type checkbox (which will solve your issue).

Today, maybe better to use a custom form field type button, and set a Yes/No options.
You can use another custom field of type "Description - separator" to add your maketing consent text, and place it just above?...
